Frequently, clients ask us: “Can you notarize my Will?” The short answer is: You do not notarize the Will itself; you notarize the Affidavit of Execution attached to it.
Why do you need this? In Ontario, for a Will to go through probate (the court process after death), the court requires proof that the Will was signed correctly.
Without it: Your executor may have to track down your witnesses years later, which can be impossible.
With it: The court accepts the Will immediately, saving your family time and legal fees.

Note: For a Will to be valid, the person signing (the Testator) must have the mental capacity to understand what they are doing. We will conduct a brief capacity assessment during the visit.
No. In Ontario, only a Lawyer can legally draft a Will for you (or you can do it yourself, which is risky). A standard Notary Public who is not a lawyer cannot give you legal advice. Fortunately, since we are Notary Lawyers, we can handle both the drafting and the finalizing.
Technically, no. A Will is legal if it is signed by you and two witnesses. However, without the notarized Affidavit of Execution, your family will face significant headaches during probate. We highly recommend getting this done immediately after signing.
Your witnesses cannot be beneficiaries (people getting money in the Will) or their spouses. We recommend using friends, neighbors, or coworkers.
