If you have been told that you need to “swear an affidavit” but are unsure about what it entails, Notary Lawyer Scarborough is here to help. An affidavit is a legal document in which an affiant or deponent makes a series of statements and then declares them to be true. Although affidavits are commonly used in court, they can also be used in other situations, such as providing evidence of your marital status when getting married abroad.
It is important to note that all statements made in an affidavit must be true, and they should be based on facts rather than theories or opinions. If you are unsure about what information you need to provide in your affidavit, the reason for which you need the affidavit will determine its content.
Notary Lawyer Scarborough can assist you in two ways when it comes to creating an affidavit. Firstly, we can help you prepare simple affidavits as long as legal advice is not required. For example, we can assist you in drafting an affidavit for a marriage license. However, we cannot help you draft an affidavit to support a claim in court, which requires the expertise of a lawyer. Secondly, we can help you swear the affidavit by acting as Commissioners of Oaths or Notaries Public. If we prepared the affidavit for you, swearing it is part of the package. If not, you can bring the affidavit to one of our offices, and we will witness you sign it after you confirm that the information is true.
If your affidavit requires additional documents to support your statements, they can be attached as exhibits. Notary Lawyer Scarborough can refer to these documents and certify copies of them if needed. It is important to bring all exhibits with you when you have your affidavit sworn, and the Commissioner or Notary who witnesses your signature must also mark the exhibits.
